Auto Accident

Car Accidents and other motor vehicle truck and motorcycle accidents are almost a fact of life these days. As the roads in Central Florida become more congested with commuters and vacationers, we know that accidents are bound to happen. Many of these accidents are relatively minor – the car needs some work and you are sore for a couple of days, but some accidents are significantly more severe. Injuries can range from traumatic brain injury to loss of a limb to paraplegia or quadriplegia – or even death.

If you’ve been injured in a car, motorcycle or boating accident, you likely have suffered certain economic losses, such as time off from work, damage to your vehicle and its contents, and hospital or doctor expenses. But you should also be able to receive compensation for your pain and suffering, any loss of enjoyment of life, any scarring, or any other loss suffered from the accident now and in the future. And, of course, if you lost a loved one in the accident, you have a wrongful death claim that needs to be brought.

Florida is a no-fault state which means that every driver with a car or truck must have personal injury protection (or PIP) coverage.

PIP coverage covers:

  • 80% of your medical bills
  • 60% of your lost wages up to $10,000
  • Regardless of who was at fault in the accident

To recover your other damages, you need to bring a claim against the driver or owner of the at-fault vehicle and/or a claim under your uninsured motorist coverage or a resident relative’s coverage (if any).

The attorney you choose should have experience with all types of motor vehicle cases: those involving automobiles, motorcycles, or 18-wheel trucks. Your attorney should be able to demonstrate trial competence as well as being able to determine when a settlement offer is a fair one and would be in your best interests to take. Your attorney should be always looking out for your best interests.

Wrongful Death

Wrongful death is a death caused by another person committing a negligent or intentional act of misconduct. Examples include careless driving:

  • Lack of adequate security at a business
  • Failing to maintain a premise in a reasonably safe condition
  • Even a dog attack

If your loved one has been the victim of a wrongful death, you are entitled to compensation for the loss of your loved one, just as you would be entitled to compensation for any other personal injury.

You can receive compensation for any actual monetary loss you have suffered as a result of the loss of your loved one. You can also, however, be compensated for loss of love and companionship, in the case of a spouse, or loss of guidance and love, in the case of a child. And if you are a relative of the deceased who relied on the deceased for monetary support, you may also be entitled to compensation.

Nobody is na├»ve enough to believe that money can ever completely compensate you for the loss of a loved one, but you shouldn’t be left to carry on, deprived of that person’s love and support, as well as income, without some compensation for your loss.

Insurance Disputes

An insurance contract provides the peace of mind that you are protected financially in the event of an unexpected loss.

Many people assume that if they pay their premiums the insurance company will fulfill their obligation and pay for the claims. Unfortunately, this is frequently not the case. Insurance companies are in the business of insurance to make money. There are many instances where insurance companies wrongfully deny your claim even if you pay your premiums on time and do everything right.

Over the past few decades, insurance companies have become more and more aggressive when adjusting claims. Their aggressive tactics are implemented in order to reduce the amount of money they pay on claims and therefore increase their profits. Just in the last few years, there has been a disturbing increase in the number of cases where insurance companies refuse to pay. We are here to stand by you and help you battle your insurance company. You have paid into that company and now you deserve to have them stand by their policy.

When making a claim with an insurance company you should speak with an attorney to discuss your rights. Do not allow yourself to become a victim of an insurance company or their adjusters.

Premises Liability

Premises liability is a general term which covers all types of injuries or accidents which may occur on a business or private property.

In Florida, the owners and operators of businesses or private property (including personal residences) have a responsibility to make their properties safe for the people who visit or shop there.

A claim for injuries which occur on the property of others may result from accidents such as a slip and fall or where objects fall from a shelf upon someone or even incidents where someone has been assaulted, robbed, raped, or murdered on the premises. Florida law requires that stores, restaurants and business property owners maintain the premises in a safe and prudent manner to prevent harm to their customers and those whom they invite to come upon the premises. The owner or operator of a property or a business is legally responsible for another person’s injuries, if they either created a dangerous condition on their property, knew of but did not remedy a dangerous condition timely, or failed to properly conduct inspections of the property which would have revealed the dangerous condition so that it could be remedied before an accident or incident occurred.

If you suffered an injury because a property owner has failed to use due care for your safety you may be entitled to recover money damages for your medical expenses, lost wages, pain and suffering, scarring, disfigurement, disability and inability to lead a normal life.

Products Liability

When you purchase a product, you believe that it will perform as it is supposed to in a safe and effective manner.

Unfortunately, too often, people find out that the manufacturer hasn’t taken enough care in developing or making the product for this to be the case. When that happens and you suffer a serious personal injury as a result, you need an aggressive team on your side to help you recover compensation for what you have lost and suffered.

Examples of Defective Products:
  • SUVs that easily roll over
  • Exploding pressure cookers
  • Defective tires
  • Defective airbags
  • Defective automobiles
  • Dangerous children toys
  • Defective playground equipment
  • Dangerous farm equipment
  • Lack of adequate warning labels
  • Lack of shielding or guardrails
  • Defective power tools
  • And much more.

These cases all have one thing in common: a person who purchased a product, believing in good faith that the item would perform as advertised, and was injured by the defective product. People who are injured by products deserve to be compensated for their suffering and losses.

If you or a loved one has been injured by a defective or dangerous product of any kind, contact us online or call The Mott Law today at 407-878-7853 for a free consultation. And remember – if we don’t recover money for you, you don’t pay.
